In the event this Refund Policy conflicts with any agreement you have with Artemz, including, but not limited to, the Artemz Terms & Conditional, such Agreement will govern. Capitalized terms used in this policy but not defined shall have the same meaning ascribed to them in the Agreement.
Artemz Business Customers are eligible for refunds under certain conditions. As with Individual Paid Service subscriptions, if we issue a refund or credit for an Artemz Business subscription in one instance, we are under no obligation to issue the same refund or credit in the future.
TERMINATION BY CUSTOMER
Terminations eligible for refund:
For Customers whose Accounts are paid annually through credit card billing and who have three (3) or more End User seats, pro-rated refunds are available for all but two (2) of the Customer’s total number of seats. For example, if a Customer with ten (10) End User seats cancels her Account six (6) months into a twelve (12) month term, her credit card will be refunded one-half (50%) the cost of eight (8) seats.
Terminations not eligible for refund:
Customers whose Accounts are paid monthly through credit card billing can remove any seats or cancel their Business subscription before the next payment cycle. Customers whose Accounts are paid via invoice, whether monthly or annually, can remove seats or cancel their Business subscription before the next payment cycle. Changes in any of these cases will be reflected in the next billing cycle.
Other than as stated above, we reserve the right to issue refunds or credits at our sole discretion, or as required by applicable law.
TERMINATION BY CUSTOMER DUE TO CHANGES IN ARTEMZ BUSINESS AGREEMENT
In the event Customer does not wish to continue using Artemz Business under the terms of an Amended Agreement as described in the Artemz Business Agreement, Section 21(h), Customer may request a partial refund, and Artemz will refund the prorated portion of any prepaid Fees applicable to the period after the effective date of termination. Please refer to Section 21(h) of the Evernote Business Agreement for instructions on how to provide notice of cancellation.
TERMINATION BY CUSTOMER FOR MODIFICATIONS OR INTERRUPTIONS TO THE ARTEMZ SERVICE.
As described in the Terms & Conditional section entitled, “Right to Modify the Service,” where a modification or interruption of any part of the Artemz service adversely affects the Artemz Business Customer and alternative remedies as specified in our Terms of Service are not available, we may refund a portion of the Customer’s Evernote Business subscription fee equal to the remaining unused term of the Evernote Business subscription, as we determine appropriate or as may be required by applicable law.
TERMINATION BY ARTEMZ
Artemz will refund the prorated portion of any prepaid Fees applicable to the period after the effective date of termination.
